Famed Storm Chaser Killed in Head-On Collision

    Mon, 06 Feb 2012 21:00:00 -0600

Andy Gabrielson spent much of his life pursing the majestic, powerful, and life-threatening tornados that sweep across the Midwest every year. During his career, Mr. Gabrielson chased tornados across twenty-six states and provided news organizations and the public with invaluable information and unforgettable images about the destructive and beautiful storms he tracked.

Tragically, just a day after an in-car interview with a Dallas television station intended to highlight his work, Mr. Gabrielson was killed in a head-on collision with a driver travelling the wrong way down the highway. For all the times Mr. Gabrielson dodged tornados, it was a negligent driver, not a powerful storm, which ultimately took his life.

Non-Invasive Options Make Transvaginal Mesh Complications Even More Tragic

    Mon, 06 Feb 2012 17:12:54 -0600

Thousands of American women are coming to terms with the fact that the transvaginal mesh surgery which caused their complications may not have been necessary to address their stress urinary incontinence (SUI) or pelvic organ prolapse (POP). Although in some cases surgical procedures and mesh-based transvaginal solutions may be required, numerous non-mesh, non-surgical options, such as native tissue or biologic graft vaginal repairs, have been used to resolve SUI and POP.

The tragic reality is that not only should these patients have never experienced the pain and discomfort of a mesh malfunction, but in many cases a less risky, less invasive procedure might have accomplished the goal of preventing SUI and POP – without the side effects that have hurt so many.

The Dallas law firm of Fears Nachawati helps victims and their families just like you. Agreeing to medical care to deal with your SUI and POP was not the same thing as giving consent to a dangerously designed medical product. For many people dealing with transvaginal mesh complications, their pain is unnecessary and their rights may have been violated. Want to find out more about your rights and protections under the law? Paxil Doubles Heart Defect Risk in Newborns

    Sat, 04 Feb 2012 14:17:59 -0600

According to the Food and Drug Administration (FDA), several recent studies suggest that women who take Paxil (paroxetine) during the first three months of pregnancy increase the risk that their child is born with heart birth defects by an astonishing 150 to 200 percent. The types of heart defects observed in the research were atrial and ventricular septal defects and ranged in severity from minor to serious, requiring surgery.

The risk of injury was so severe that the FDA requested that the drug manufacturer responsible for producing Paxil downgrade Paxil from Pregnancy Category C to Pregnancy Category D.

Was your child born with a heart condition that might be related to your Paxil prescription? You’re not alone. Thousands of women have taken Paxil during pregnancy without realizing the effects that this dangerous drug might have on their fetus. Do you want justice for your family and yourself? You don’t have to wage that fight alone. Talk to the dangerous drug attorneys today for your free consultation. Call us at 1.866.545.8364 or email mn@fnlawfirm.com. We’re ready to fight for you!

Safe Drivers Give Motorcyclists More Space, Not Less

    Fri, 03 Feb 2012 10:31:28 -0600

It may seem counterintuitive, but driving experts and even state administrators recommend that drivers should give motorcycle riders more space on the road, not less, despite their smaller size. The reality is that the factual standard for driving safely near a motorcycle is higher than it is for driving near cars.

In Texas, a state of nearly 24,000,000 people, motorcycle drivers make up a tiny fraction of the people on the road. Yet these roughly 1,000,000 drivers disproportionately suffer injury and death on the highway. In fact, in terms of relative size, considerably more motorcyclists are injured or killed on Texas roads than drivers of passenger cars.

Why is that? Passenger car drivers tend to blame motorcyclists themselves. The evidence, however, tells a different story. In compliance with state law, drivers of motorcycles take specialized courses and in many cases, receive advanced training, too. Additionally, more than 75 percent of accidents involve another car, and a significant majority occur in the context of multi-car collisions in which the motorcyclist is merely at the wrong place at the wrong time.

Legal Commentary – Majed Nachawati – Author

Unfortunately, innocent misconceptions about how and why motorcyclists are involved in accidents can do considerable damage at a negotiating table or in a courtroom. Mediators and juries often fall in the trap of blaming the victim, as if choosing to ride a motorcycle was somehow the same thing as choosing to suffer a debilitating highway accident because of a car driver’s negligence.

Victims of motorcycle accidents need legal representatives who not only understand the law that governs their case, but also who recognize the uphill battle that their clients face as a result of these misconceptions. Our success in the courtroom and at the negotiating table suggests that a clear message about the cause of an accident can get through, but it takes an articulate, knowledgeable, and experienced attorney to succeed at communicating it.

Fortunately for you, that’s exactly who the attorneys at Fears | Nachawati are. Contact our experts today to find out how we can help you recover from your motorcycle accident. The consultation is free, so you have nothing to lose. Let us help you!

Did Your Zoloft Prescription Injure Your Child?

    Fri, 03 Feb 2012 09:51:59 -0600

Zoloft (sertraline) is a powerful prescription drug that doctors use to combat depression in their patients. As an antidepressant prescribed to adults, it has been successful.

In the last several years, however, the drawbacks of Zoloft (sertraline) have become increasingly clear. For a large and growing number of families, Zoloft and similar selective serotonin reuptake inhibitor (SSRI) antidepressants have caused injury to their children. Specifically, as the Food and Drug Administration has warned since 2005, pregnant mothers who take Zoloft while pregnant can transmit this dangerous drug to the child growing inside them.

At birth and in the weeks and months afterwards, the effects of this relatively high in utero exposure to Zoloft (sertraline) become alarmingly evident. Zoloft children demonstrate symptoms that include behavioral disturbances and physical effects such as abdominal, brain, lung, and heart abnormalities. In many cases, these conditions are serious and the source of considerable physical pain, emotional suffering, and financial expense.

The dedicated, experienced, and trusted attorneys at the Dallas law firm of Fears Nachawati know how to help families like yours. For years, we’ve fought for the legal interests and financial future of victims and their families. Your child, spouse, and loved ones deserve their day court. We fight to see that they get it. Aggressive Lexapro Marketing Puts Profits over Patients

    Thu, 02 Feb 2012 12:11:07 -0600

Lexapro (escitalopram) is a dangerous drug that has been linked to a variety of neonatal birth defects, including persistent pulmonary hypertension (PPHN) and potentially severe withdrawal symptoms. You may know a little about the risks of Lexapro, but do you know about the drug maker behind the product?

Forest Laboratories, the maker of Lexapro, has long adopted an aggressive marketing strategy specifically designed to convince doctors to prescribe Lexapro instead of other cheaper or more appropriate options. In fact, the sharp practices of Forest Laboratories have resulted in multiple whistleblower lawsuits and allegations of kickbacks to doctors.

While it’s important to note that these whistleblower lawsuits weren’t initiated because of the prescription of Lexapro to pregnant women, these controversies – and the factual record they illuminate – reveal the aggressive, high-pressure strategies that Forest Laboratories has used against doctors, perhaps including your OB/GYN physician.

Did you find out what you needed to know about the risks of Lexapro during visits with your physician? Although you didn’t know it, your physician may have been under pressure to advise you to continue taking Lexapro, despite FDA warnings.

Want to find out more about the relationship between Forest Laboratories, Lexapro, your physician, and your child’s PPHN? Talk to the dangerous drug attorneys at Fears Nachawati for the latest information in this important area of health and personal injury law.
